Argentario Obidiving by Susanna Moursi, based in Porto Santo Stefano (GR) in via del molo 56, 58019, is a service company with the flexibility to carry out online retail sales, focusing mainly on offering services but maintaining the possibility of marketing products through digital platforms. The company offers a wide range of diving services, including dives, SSI certified courses, diving equipment rental and skippered boat rental for tours and public sea activities or for private events.

The use of the website (www.obidiving.it) and the services offered by Argentario Obidiving implies full and unreserved acceptance of these general conditions.
2. User Account:
Users have the possibility to create a personal account on the Argentario Obidiving website. You are responsible for maintaining the confidentiality of your login credentials and for using your account securely.
3. User Responsibilities:
The User declares and guarantees that he has provided accurate, truthful, updated and complete information regarding his identity, age, gender, experience and personal data in general. Argentario Obidiving assumes no responsibility for the accuracy and completeness of the information provided by Users. Under no circumstances may Argentario Obidiving be held liable, towards Users or third parties, for damages resulting from inaccurate or incomplete information provided by Users.
4. Services Offered:
Diving Services : include the use of diving facilities such as showers, changing rooms, bathrooms and compressed air recharging services.
Diving : assistance in carrying out the diving activity independently or with the guidance of an instructor. Diving can also be done from shore without using the boat
SSI Certified Diving Courses : the company has SSI certified instructors authorized to provide courses and issue certifications for obtaining diving licenses.
Resale of Diving Equipment : the company is an authorized reseller of brands such as Mares, Rofos and Shearwater, acting as an intermediary between the customer and the supplier company for the purchase or assistance of equipment.
Diving Equipment Rental : offers the rental service of equipment for private use, both connected to diving and for external use.
Boat Rental with Skipper : the company offers the boat rental service with skipper for tours and public sea activities or for private events.

Argentario Obidiving offers its services both for direct sales in person and via online booking. Customers can use the services by visiting the company structure directly or by booking online through the website (www.obidiving.it).
6. Booking of Services:

7. Confirmation of Reservations:
The booking is to be considered confirmed only after receiving explicit confirmation from the company, which can be done by telephone, email, messaging app or chat on the company's official social media profiles. 8. Prices:
The prices indicated by Argentario Obidiving include VAT, unless otherwise indicated.

12. Shipping Responsibility Note:

However, the company declines all responsibility for any delays, loss or damage to packages during transport. 13. Returns and Replacements:
Argentario Obidiving offers the possibility of returning the products purchased within 14 days from the delivery date. Returns are the responsibility of the customer and must be made in accordance with the following conditions:

13.3 Examination of Returned Products: After receiving the return, the company will examine the product to check for any defects or damage. The return will be accepted only if the product is in the same condition in which it was received and does not show signs of wear or damage caused by improper use.

13.4 Acceptance of the Return: If the return is accepted and problems relating to the manufacturing of the product arise, Argentario Obidiving will proceed with the replacement of the defective product with a new one, without additional costs for the customer; alternatively, the customer can request the return of the amounts paid.

13.5 Refund: If the customer chooses a refund, the amount will be returned via bank transfer within 10 working days from the date of acceptance of the return.
14. Limitation of Liability:
Argentario Obidiving disclaims any liability for direct, indirect, incidental, consequential or special damages arising from the use or inability to use the services offered, including but not limited to lost profits, business interruptions, loss of data or damage to reputation .
15. Warranty Exclusion:
Argentario Obidiving provides its services "as is" and "as available", without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.
16. Compensation:
Users agree to indemnify and hold harmless Argentario Obidiving, its managers, employees, agents and partners from any liability, loss, claim and expense (including legal fees) arising from the violation of these general conditions or from the use of the services offered.
17. Force Majeure:
Argentario Obidiving non sarà ritenuta responsabile per eventuali ritardi o fallimenti nell'esecuzione dei suoi obblighi derivanti da cause al di fuori del suo ragionevole controllo, inclusi ma non limitati a eventi di forza maggiore, guasti tecnici, interruzioni di rete, scioperi o disordini civili.
18. Termination of the Contract:
Argentario Obidiving si riserva il diritto di interrompere o sospendere l'accesso ai suoi servizi, senza preavviso, in caso di violazione delle presenti condizioni generali da parte dell'utente. In caso di risoluzione del contratto, le disposizioni relative a limitazioni di responsabilità e indennizzo rimarranno in vigore.
